A divorce Judgment resolves five basic legal issues: 1) Termination of marital status; 2) Asset division; 3) Spousal support; 4) Child custody and parenting plan (i.e. visitation); and 5) Child support. Learn more about each of these issues below.
Asset Division
During your marriage you likely acquired some, if not substantial, assets. This will likely include your residence, financial accounts, and retirement plans. You or your spouse may even have started a business during marriage, or perhaps one spouse owned a business prior to marriage. You or your spouse may have inherited funds or real property, and the inheriting spouse may have invested the inherited funds into the family residence. How your assets and debts will be divided will have a significant impact on your life post-divorce.

Spousal Support
Your circumstances are unique, and therefore, you should have a spousal support order tailored to your needs, whether you are a potential payor of spousal support or a potential recipient of spousal support. There are many factors that the Court must consider in ordering a spousal support award, including the length of the marriage; the ability of one spouse to pay the other; the supported spouse’s history of employment (if any) during the marriage; the health and age of both spouses.

Child Custody & Visitation
When parents first separate—regardless of whether they are married or not—the most immediate questions that must be answered are with whom the children will live and how often will one parent spend time with the children. While an agreement by the parents on these immediate issues is the best solution, sometimes, parents cannot reach an agreement despite their best efforts. Lee Family Law is here to assist you in reaching a most beneficial custody and parenting plan for your children.
As your children grow older, and your circumstances or the parent’s circumstance change, you may need to modify an existing custody order or parenting plan. Depending on the current custody and parenting plan order, whether the Court will modify an existing order may depend on whether you can show that there has been a change in circumstances and that your desired custody and/or parenting plan is in the best interest of your children. Child Support
Children have a right to be financially supported by their parents. Child support is primarily determined by the income of the parents and the time each parent spends with the children. There may, however, be other circumstances that affect that calculation of child support, for example, if one parent has been and continues to be the stay-at-home parent or if one parent is deemed an extraordinarily high income earner.
You may have concerns about the cost of child care or medical care for your children. Perhaps your children engage in costly extracurricular activities. Fortunately, child support may be able to include and cover these additional costs.

Post-Judgment Support Modifications
Now that some time has passed since your divorce or paternity matter was finalized, you may wish to modify an existing order regarding spousal and/or child support. Yours or your former partner’s financial circumstances may have changed so that an updated support order may be appropriate.
